1. Acceptance of Terms
These Terms of Service are entered into by and between you and Ashwani Innovations ("Company," "we," or "us"). The following terms and conditions, together with any documents they expressly incorporate by reference, govern your access to and use of our website, dashboard portals, and cloud services.
By clicking to accept or by using the website/dashboard portal, you accept and agree to be bound and abide by these Terms of Service and our Privacy Policy.
2. User Accounts & Security
To access some dashboard portals, product listings, or custom cloud software configurations, you may be asked to provide registration details.
**Account Accuracy:** You agree that all details you provide to configure your client portal are accurate, current, and complete.
**Credential Security:** You must treat usernames, API keys, and temporary tokens as strictly confidential and not share them with third parties.
**Breach Notice:** You agree to notify us immediately of any unauthorized access to your billing or developer portals.
3. Fees, Subscription, & Payments
Some of our software tools are offered under monthly or yearly subscription structures, or one-time license fees.
Subscriptions
Subscription products auto-renew. You authorize us to collect fees using your saved credit cards/UPI details unless cancelled.
Cancellation
You can toggle auto-renew off from your Subscription Dashboard at any time. Active subscriptions remain open until the end of the term.
4. Acceptable Use Guidelines
You agree to use our systems solely for lawful business operations. You agree NOT to:
Attempt to decompile, reverse-engineer, or leak source code files.
Inject malware, viruses, or spam payloads into cloud dashboard inputs.
Conduct automated load-testing or scrape APIs without written consent.
5. Intellectual Property Rights
The website, client portals, admin dashboards, databases, codebases, icons, and logo assets are owned by Ashwani Innovations and are protected by international copyright, trademark, patent, and trade secret laws. Your purchase of a software license grants you a limited, non-exclusive, non-transferable license to deploy and utilize the system in accordance with your EULA.
6. Liability & Warranties Disclaimers
YOUR USE OF THE WEBSITE AND THE PORTALS IS AT YOUR OWN RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
In no event will Ashwani Innovations, its developers, or affiliates be liable for damages of any kind, under any legal theory, arising out of your use of or inability to use our systems.
7. Disputes & Governing Law
All matters relating to the Website and these Terms of Service, and any dispute or claim arising therefrom, shall be governed by and construed in accordance with the laws of India, without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of these Terms shall be instituted exclusively in the federal or state courts located in New Delhi, India.
